Terms of Service

These Terms of Service ("Terms") govern your use of infoholick ("the Service") provided by Hypia ("we"). By using the Service, you agree to these Terms. In the event of any discrepancy between the Japanese and English versions, the Japanese version shall prevail. For the handling of personal information, please refer to our Privacy Policy.

1. Service Overview

The Service is a web application that provides RSS/Atom feed subscription, reading, and AI-powered curation features.

2. Plans, Pricing & Payment (Planned)

  1. The Service plans to offer a free plan (Free) and paid plans (Starter, Pro, Infoholick).
  2. Paid plans are billed monthly, with the first payment due at signup.
  3. Payment is accepted via credit card (through Stripe) in Japanese yen only.

3. Auto-Renewal & Cancellation (Planned)

  1. Paid plans auto-renew monthly.
  2. You may cancel at any time from the Settings page. After cancellation, you retain access to your current plan until the end of the billing period, after which you will be moved to the Free plan.

4. Prohibited Activities

You must not:

  • Violate any applicable laws or regulations
  • Interfere with the operation of the Service
  • Infringe on the rights of other users or third parties
  • Engage in unauthorized access or reverse engineering of the Service
  • Excessively use the API in a manner that impacts service stability

5. Service Interruption & Termination

  1. We may temporarily suspend the Service without prior notice for maintenance, incident response, or other unavoidable reasons.
  2. We may terminate all or part of the Service with 30 days' prior notice. No refund will be issued for fees already paid.

6. Disclaimer & Limitation of Damages

  1. We do not guarantee the completeness, accuracy, or usefulness of the Service.
  2. AI curation results are provided for reference only and are not guaranteed to be accurate.
  3. Our liability for damages attributable to us is limited to the amount of fees you paid in the preceding one month.

7. Governing Law & Jurisdiction

  1. These Terms are governed by the laws of Japan.
  2. The Service is intended for users in Japan and is operated under Japanese law.
  3. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Yokohama District Court.

8. Intellectual Property

All intellectual property rights related to the Service, including AI-generated curation text, belong to us or the respective rights holders. Users may view and use such content to the extent necessary for their use of the Service.

9. Account Deletion

Users may request account deletion from the Settings page or by emailing info@hypia.jp. We will delete the account and associated data in accordance with the periods set forth in our Privacy Policy.

10. Exclusion of Anti-Social Forces

Users represent and warrant that they are not members of organized crime groups, associates of such groups, or any other anti-social forces. We may suspend access and delete accounts without prior notice if we determine that a user falls under any such category.

11. Force Majeure

We shall not be liable for any failure or delay in providing the Service caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, epidemics, power outages, failures in communication networks or cloud infrastructure, and enactment or amendment of laws or regulations.

12. Changes to These Terms

We may modify these Terms only when the changes serve the general interest of users, or when the changes are reasonable in light of the necessity and appropriateness of the modifications. We will notify users of the changes and effective date through the Service a reasonable period in advance.

13. Eligibility

The Service is intended for users aged 18 or older. Users under 18 must obtain consent from a legal guardian before using the Service. We may suspend or delete accounts if we determine that a user does not meet the age requirement.

14. Assignment

We may transfer our position, rights, obligations, and user information under these Terms to a third party in connection with a business transfer (including but not limited to business sale, merger, or corporate split), and users hereby consent to such transfer in advance. Users may not assign or pledge their position, rights, or obligations under these Terms to any third party without our prior written consent.

15. Severability

If any provision of these Terms, or any part thereof, is found to be invalid or unenforceable under applicable law, the remaining part of such provision and all other provisions of these Terms shall continue in full force and effect.
